First Time DUI

  2. BAC .10 – .159
    1. Ungraded Misdemeanor
    2. 2 days to 6 months Jail
    3. $500 to $5,000 fine
    4. 12 month license suspension
    5. Alcohol highway safety school
    6. Treatment when ordered
      *ARD Eligible
  3. BAC .16 +
    1. Ungraded Misdemeanor
    2. 3 days to 6 months Jail
    3. $1,000 to $5,000 fine
    4. 12 month license suspension
    5. Alcohol highway safety school
    6. Treatment when ordered
      * ARD Eligible

Second Time DUI

  1. BAC .08 -.099
    1. Ungraded Misdemeanor
    2. 5 days to 6 months jail
    3. $300 to $2,500 fine
    4. Alcohol highway safety school
    5. Treatment when ordered
    6. 12 month license suspension
    7. 1 year ignition interlock
      *Maybe ARD Eligible
  2. BAC .10 – .159
    1. Ungraded Misdemeanor
    2. 30 days to 6 months Jail
    3. $750 to $5,000 fine
    4. Alcohol highway safety school
    5. Treatment when ordered
    6. 12 month license suspension
    7. 1 year ignition interlock
  3. BAC .16 +
    1. 1st degree Misdemeanor
    2. 90 days to 5 years Jail
    3. $1,500 to $10,00 fine
    4. Alcohol highway safety school
    5. Treatment when ordered
    6. 18 month license suspension
    7. 1 year ignition interlock

Third Time + DUI

  1. BAC .08 -.099
    1. 2nd degree Misdemeanor
    2. 10 days to 2 years Jail
    3. $500 to $5,000 fine
    4. Treatment when ordered
    5. 12 month license suspension
    6. 1 year ignition interlock
  2. BAC .10 – .159
    1. 1st degree Misdemeanor
    2. 90 days to 5 years Jail (*4th DUI at this BAC is 1 – 5 years prison)
    3. $1,500 to $10,000 fine
    4. Treatment when ordered
    5. 18 month license suspension
    6. 1 year ignition interlock
  3. BAC .16 +
    1. 1st degree Misdemeanor
    2. 1 to 5 years prison
    3. $2,500 to $10,000
    4. Treatment when ordered
    5. 18 month license suspension
    6. 1 year ignition interlock
