No Matter The Age, Drinking and Driving Don’t Make For a Good Mix

Wednesday, September 21st, 2011

Driving under the influence is not the only way someone can get hurt while they are intoxicated; although it is the most prominent way, only because there are legal consequences that come along with the charge. However, those who choose to do foolish things while under the influence of alcohol need to realize that there will be legal implications for their actions and consequences that will affect every aspect of their lives.

A situation very similar to this happened to three boys in Pennsylvania. Apparently the boys had been drinking too much alcohol, and began to wander around. In their wandering, they approached a barn that contained horses inside, and the boys became intrigued with the large animals. The intoxicated boys went into the barn, began to play with the horses, and then one of the boys began to try to ride one of the horses. The horses were spooked by the boys’ unexpected presence and kicked one of the boys in the head. The injured boy was then rushed to the nearest medical center, where he was treated for his head trauma, and his current medical condition has not been released yet. The other two boys did not receive any other harm comparable to the head injury of their friend.

When the police arrived on the scene to carry the injured boy to the hospital, they were able to confirm that all of the boys were intoxicated, and had consumed large amounts of alcohol. These boys are now preparing to face serious legal consequences for their actions because not only did they trespass onto someone else’s property, they consumed alcohol while they were still under the age of twenty-one. Their ages range from twelve to seventeen.

Hopefully these boys will be an example to all of the minors who choose to drink under age–and prove that minors will not get away with it, and that their illegal actions will be pursued to the fullest extent of the law.

Many people disregard underage drinking outside the realm of driving, and that is a very dangerous thing to do. Teenagers also do not realize how dangerous it is to drink while under the age of twenty-one.  While intoxicated, teenagers do not have control over what they are doing, and often times do not have good discretion on the choices that they make. This is not to say that adults do not become unaware of what they are doing while they are intoxicated; but they are over twenty-one.

It is wise to know that if you choose to drink while under the age of twenty-one there will be serious ramifications for your serious lack of judgment.

Pittsburgh DUI Attorney Discusses DUI Drug Stops and Common Mistakes

Wednesday, March 9th, 2011

You are driving home and feel a cold chill run down your spine as you see the flashing red lights and realize you are about to be pulled over by the police.  You are not speeding and have not been drinking, but you know that you are feeling a little drowsy from the pain medication prescribed by your doctor for back pain.  You realize you may have been drifting a little in your lane.  You breathe a sigh of relief assuming everything is fine because you have not done anything wrong and will just explain to the officer what happened.

This scenario happens every day in Pittsburgh and elsewhere throughout Pennsylvania.  Unfortunately, instead of driving home, the driver ends up being arrested and facing a drug-related DUI charge.  You have just made three mistakes.  You assumed that you could not be arrested and charged for DUI for taking a medication that was prescribed by your doctor. You also made the mistake of believing “explaining your side of the story” would somehow help the situation.  Most importantly, you failed to get legal advice from an experienced Pittsburgh DUI attorney before speaking to the police.

Pittsburgh DUI defense attorney Michael V. Worgul has represented thousands of people throughout Pennsylvania who have made these same mistakes.  DUI offenses in Pennsylvania may be charged and prosecuted according to three tiers based on a person’s blood alcohol content (BAC) and other aggravating factors, but a drug-related DUI is included within the highest tier of DUI offenses under Pennsylvania DUI law.

If you are convicted of driving under the influence of illegal drugs and certain controlled substances, your offense is automatically placed into the highest BAC category, which carries extremely serious penalties.  If you are driving under the influence of illegal drugs or certain controlled substances without a valid prescription, you may also be charged with a separate drug offense related to your possession of the illegal drug or controlled substance.

Pittsburgh DUI Lawyer Explains – What Is a DUI Drugs Case?

Wednesday, March 2nd, 2011

Many people in Pennsylvania believe that they can only be charged with a drug-related DUI (DUID) if they have taken illegal narcotics.  However, Pennsylvania DUI law permits a person to be arrested and charged with DUI for driving under the influence of legal drugs (such as over-the-counter drugs or prescription medications) as well as illegal narcotics.  Although Pennsylvania DUI drug cases involving illegal narcotics are common, Pennsylvania prosecutors are filing an increasing number of DUI drug cases against people who have taken legally prescribed or over-the-counter medication.

A person arrested and charged with driving under the influence of drugs faces not only the top tier of penalties under Pennsylvania DUI law but may also face charges related to possession of an illegal drug or a controlled substance without a prescription.  You may find yourself charged with a generic DUI as well as possible drug charges based on possession or use of an illegal drug depending on the specific facts of your case.

The good news is that DUI drug cases may be more difficult for a prosecutor to prove.  This is because a properly conducted prosecution will cost the District Attorney more money to prosecute than a generic DUI prosecution.  A prosecutor in a DUI drug case may need to have the defendant’s blood or urine sample tested for a variety of controlled substances.  With each particular category of drug tested, the cost of the test increases.  The prosecutor may also need to present testimony from a medical expert as to the impact of a certain quantity of a specific drug on a person’s driving ability.
