Traffic Violations Could Lead To A DUI Charge

Monday, March 26th, 2012

Everyday we have to drive or rely on someone to give us a ride in order to get our daily tasks done. Whether it is going to school or work, running errands, or having to pick up the kids from their afterschool activities today we are constantly on the go. However we rely on the idea of safety to be present in that of every motor vehicle operators mind, especially when it deals with that of the issue of drinking and driving. Yet, more and more individuals today are being charged with drinking and driving.

Whether you are young or old you are bound to run into a traffic ticket here or there, but usually not that of a drinking and driving charge. We all have our moments when are running late, or simply just trying to get from Point A to Point B quickly. Sometimes as a result of this you might not see a stop sign, run a red light, or simply just overly speed over that of the speed limit. Usually you will run into a ticket or a violation for these small crimes, but you can easily get a DUI charge from these.

When you speed or do something of this nature you are giving law enforcement officers just what they need. Many officers jump at these traffic violations as the result of the individual drinking and driving and simply being caught before serious consequences could take place. However, most of the time the only crime the individuals are truly at fault for is that of speeding or being careless. Yet, many falsified DUI cases begin with these circumstances and leave an individual at fault for much more than what was truly done.

A DUI is a serious crime that can affect the life of an individual now and later. When you are falsely charged with driving while under the influence of alcohol or other drugs you need to fight for your rights with an experienced, dedicated lawyer at your side from start to finish. Without one, you can easily be convicted of a far more serious crime than what was actually committed.

When you have been charged with a criminal offense, you want an experienced defense lawyer protecting your rights every step of the way. I am attorney Michael V. “Click It or Ticket”

Tuesday, December 27th, 2011

As seen throughout many locations we are all familiar with roadway safety and it’s importance. We all know that we are not on the road to horseplay, or just hang out we are there to get from one location to the next hoping that our travel entails good weather, good music, and even better safety. However, how does a person truly make sure that not only themselves, but also all occupants of the motor vehicle are safe from the time of the start to the stop of the engine?

Recently, a new safety campaign that has been instituted by the Department of Transportation nationally recognizes that seatbelts in the past have contributed to the deaths of many individuals. A new law has been installed stating that all drivers of motor vehicles as well as their passengers are required to wear safety belts. This law not only focuses on the safety of driver’s of motor vehicles, but all individuals on the roadways. As a result, law enforcement officers are able to write traffic violations to drivers who do not have their seatbelts on, or to passengers if they do not wear them during the time the vehicle is in motion.

Children are also an aspect of this law and their safety. According to the law, children are required to have booster seats, or car seats depending or their age, and height. Without these seats children not only face the likely hood of being at danger more, but also the potential for injury if an accident does occur. Studies show that children are still constantly developing mentally and physically for many years, and if injured in a car accident their growth can be severely altered for the worse.

The campaign “Click It or Ticket” is not only within Pennsylvania, but taking over the country. The national campaign highlights the true essence of safety for all in the attempt that with so many variables on the roadways people can decrease their likelihood of injury by simply wearing their safety belt.

Distracted Driving Soon To Be Law?

Friday, December 16th, 2011

In the world we live in today we have many responsibilities and duties within our lives. In order to meet the supply and demand of our personal lives, jobs, and commitments we are constantly on the go from dawn till dusk, or even later to ensure that they not only get done, but that they get done properly in order to move on to the next tasks necessary. However, as a result from the constant go or our lives we sometimes not only carry aspects from one area to another within our lives, but also on the roadways.

Texting, and talking while driving is a known thing within the country today. By the youth of America, and its many older generations it can be seen being done not only once by a person, but basically everyday. We find ourselves driving and still trying to fulfill the tasks that need to get done, or maybe you’ve simply just had a rough day and need a little cheering up. Either way, people not only need their phones for communication, but can easily be seen for social, and professional survival.

However, what does this driving habit really do not only for the operator of the motor vehicle, but also those around them? Studies have shown that those drivers who text while drive have almost identically driving patterns as those who are driving while under the influence of alcohol. Unlike DUIs, texting and driving occurs at all hours of the day, and an accident can happen when any individual could least expect it.

Currently, Pennsylvania lawmakers are currently deciding upon a bill that will impact texting and driving with tickets that cost up to $50. However, this law does not impact hands free devices for talking and texting at this point. Some lawmakers see flaws within the overall bill stating that law officers could easily profile individuals by simply having a phone raised to the steering wheel level. The bill overall has a great, and positive purpose that if signed by the Governor will help lessen accidents, and increase safety on the roadways of Pennsylvania.

Passing A School Bus Unlawfully, Beware

Thursday, December 15th, 2011

Every day we are expected to get in a vehicle of any sort at least once a day. In the world we live within today we not only have responsibilities, but expectations that we must not only hold, but also complete with success, and accomplishment. With any responsibility comes the stress of wanting to not only to complete what is asked, but also with the hopes of satisfaction for whoever reaps the benefits of each task. However, sometimes as a result of dedication we tend to overlook obvious facts, and things right in front of us.

The school bus has been known for years as a method of public transportation for students from their elementary years, to even those in high school to get them from their homes five days a week, take them to educational institutions, and then return them safely each time. However, school buses are not always looked at as the safety vehicle it truly is. Just as students have rules upon the buses, drivers around the bus must also practice proper safety to make sure that they are not only safe, but all of the students aboard as well.

When a school bus has its proper safety equipment in place and is stopped, with its arm out stating it is at a stop for students to board, or exit it is completely illegal to pass the bus. However, for some reason drivers still do this not only endangering themselves, but innocent students as well.

Law enforcement officers have installed a campaign titled “Operation Safe Stop” across Pennsylvania. This campaign is to ensure safety for all, as well as remind drivers the consequences of such an infraction. If you are caught and pulled over for passing a stopped bus you can easily face many consequences. A $250 fine will be imposed on drivers, as well as 5 points being deducted from the current license in which they hold. However, that is not even the worst part for drivers for they can have their license suspended for up to a year from this small impatience and lack of safety care.

Hopefully as we look to the future we will not have to look for laws to be installed in order for moral decency, but can rely on people and their compassion towards one another.

Traffic Violations Can Expect Higher Fines for Pennsylvania Drivers

Thursday, September 1st, 2011

With any traffic violation, an individual can expect a citation hand-in-hand with some consequences. Depending on the type of traffic violation, the consequences can easily vary from a minor impact to a major one that can leave many with paying more than just a simple fine. In Pennsylvania, motor vehicle operators could expect a much more heftier price on just a simple traffic infraction.

Many people simple speed some over the limit, run a red light or stop sign, or even just have a parking ticket that has to be paid for. Usually the fines are low in price, in comparison to the actual crime and the possibilities that could easily erupt from the occurrence. Of course, you will always have some individuals with political connections who can easily wipe a ticket clean off their slate, or go to “Driving School” to erase the ticket for learning proper driving and roadway etiquette.

However, the Governor of Pennsylvania, as well as office is considering raising the price on tickets. Although it sounds minor compared to many other financial obligations we are responsible before on a daily basis, the Governor’s office is proposing that an additional $50 should be added on to ticket fines, and $100 tacked on to anymore traffic violations associated with the ticket, such as an expired inspection sticker, or an expired car tag. Although the amount again does not sound to be financially overwhelming on the individual if only a single infraction is done, but if you happen to have a few expired pieces of paper you are looking at a ticket that could be close or even over $1,000.

Not only will the ticket, or citation, take out of your immediate income to be able to pay for it within the allotted time period, but you can easily expect you insurance price to rise as well.

Although the idea of the Pennsylvania government to increase the fine amounts associated with tickets would lessen some traffic violators, many law enforcement organizations do not support the idea of a possible increased revue tickets could project to the state government. Many officers of the law have commented in saying that if the fine amounts went up that they would feel personally obliged to let some minor infractions slide in order not to tack on such a heavy financial burden on someone who could potentially already be in a rut from the everyday difficulties that life has to offer.

Overall, the increased fines that could occur with citations in Pennsylvania both have positive and negative connotations. However, Pennsylvania should strive as a whole regardless of the price of a ticket to have safety among all roadways for not only themselves as motor vehicle operators, but also others.
